Florida couple avoids prison for child neglect in beach incident

A couple in Florida, Brian, 40, and Sara Wilkes, 37, escaped imprisonment for child neglect charges after making an out-of-court deal with prosecutors. The parents were apprehended in October 2025 when beach visitors alerted the authorities about an unattended baby at Miramar Beach. Upon police arrival, the couple had not returned to check on their six-month-old daughter, who was being looked after by Good Samaritans at the nearby Hilton Sandestin Beach Golf Resort and Spa. The parents eventually returned and admitted to leaving their baby unattended.

The Wilkes confessed that they had left their daughter under their beach tent while she slept, then took their other children for a walk, losing track of time. Surveillance footage revealed that they did not have their phones with them during the incident. Fortunately, the baby was unharmed, as confirmed by paramedics. Major Dustin Cosson from the Walton County Sheriff’s Office criticized the couple for leaving their child alone for an extended period, emphasizing the risks involved.

Following a deferred prosecution agreement in May, the Wilkes avoided jail time by paying fines, performing community service, attending a parenting class, and being restricted from visiting Walton County. They must comply with all conditions within a year, with a warning to maintain good behavior to prevent further legal action. The Florida Department of Children and Families intervened, placing the children under state custody until relatives from Texas could take over.
