WestJet Settles Sexual Harassment Lawsuit: $4.5M Deal

WestJet has agreed to settle a sexual harassment class-action lawsuit filed by over 3,000 flight attendants a decade ago, with a payment of $4.5 million. The settlement terms were approved by a B.C. judge on Monday following finalization in June. WestJet expressed satisfaction with reaching a settlement.

The lawsuit was initiated by former flight attendant Mandalena Lewis, who alleged a pilot sexually assaulted her during a layover in Hawaii in 2010. The case evolved into a class action in 2016 after additional female employees came forward, citing WestJet’s failure to provide a safe workplace with sufficient anti-harassment measures.

Despite the settlement, Lewis expressed mixed feelings, stating that while relieved the case concluded, she believes the plaintiffs did not receive full justice. The distributed settlement amount will equate to around $400 per flight attendant after deducting expenses, including legal fees. Moreover, Lewis mentioned a reduction in her agreed honorarium from $20,000 to $10,000.

WestJet plans to enhance its operations and training to prioritize the safety and well-being of its employees, aiming to foster a culture of empowerment. Additionally, the airline will engage a third-party consultant as part of the settlement terms to assess workplace conditions regarding harassment prevalence, underreporting, and response system improvements.

Lewis described the legal process as a challenging ordeal, noting the deep-rooted issue of sexual assault and harassment within the airline industry. She emphasized taking a stand not only for herself but also for other flight attendants enduring similar experiences.

Amidst differing opinions on the adequacy of the settlement, legal expert Joshua Coratti viewed the agreement favorably for WestJet, suggesting it shields the company from potential costly individual claims. He highlighted the impact of class-action lawsuits in deterring misconduct and promoting organizational accountability.
