“England and Wales to Introduce New Respect Orders for Anti-Social Behavior”

New Respect Orders, similar to ASBOs, are set to be implemented in England and Wales starting in October, as announced by the government. Policing Minister Sarah Jones will disclose to MPs that these orders will carry the potential of jail time for violations and will empower civil courts to prohibit offenders from engaging in specific types of anti-social conduct, such as public drinking in certain areas.

A Home Office spokesperson informed The Mirror that there is no predefined list of offenses that would trigger a Respect Order. These orders would be granted by a court if the behavior is deemed or likely to cause harassment, alarm, or distress, and if it is deemed appropriate to issue a Respect Order.

The government emphasized that these orders are aimed at addressing persistent offenders. Ms. Jones emphasized the impact of anti-social behavior on communities and highlighted the importance of these new measures in preventing repeat offenders from causing distress to local residents.

The Home Office confirmed that the new powers will come into effect on October 26 to fill a significant gap in the police response to anti-social behavior. In addition to banning offenders from certain areas, courts will also have the authority to require them to address the root causes of their behavior, potentially through interventions like drug or alcohol treatment and anger management courses. Breaching these orders could lead to imprisonment, unlimited fines, community service, or curfews.

Harvinder Saimbhi from ASBHelp praised the introduction of Respect Orders, emphasizing the relief it would bring to victims plagued by persistent offenders. Similarly, John Hayward-Cripps from the Neighbourhood Watch Network highlighted the impact of anti-social behavior on people’s quality of life and welcomed the government’s efforts to address persistent offending.

Respect Orders differ from ASBOs in that they are applicable only to adults and include provisions to address underlying issues contributing to the anti-social conduct.
