Two teenage boys who initially avoided custody for rape have now been sentenced to four years in detention following a review by the Court of Appeal. Known as X and Y, the 15-year-olds were originally placed on youth rehabilitation orders and supervision programs after being found guilty of raping two girls in separate incidents in Fordingbridge, Hampshire.
Another 14-year-old boy, identified as Z, also received a youth rehabilitation order for his involvement in one of the attacks and an indecent images offense. The boys had shared videos of the assaults on social media, leading to a reevaluation of their sentences by the Court of Appeal.
During the hearing, Lady Chief Justice Baroness Carr, along with other judges, addressed the boys directly via a live video link, informing them that their actions were severe enough to warrant detention. They highlighted the gravity of the crimes committed, including the filming of the assaults, which exacerbated the situation.
The Court of Appeal’s decision to impose imprisonment on the older boys was influenced by the Attorney General’s referral under the Unduly Lenient Sentence scheme. The judges emphasized the impact on the victims’ lives and the underestimation of the offenses’ seriousness in the initial sentencing by Judge Nicholas Rowland.
While X and Y were given four years in detention, the third boy, Z, received a different sentence due to his age and limited physical involvement in the assaults.
