“Charlottetown Police Under Fire for Mishandling Cold Case Evidence”

Charlottetown Police Services face scrutiny over their handling of a notable P.E.I. cold case as charges against the suspect were recently dropped just before the trial. The provincial Crown Attorney’s Office revealed that the charges against Todd Joseph Irving in the 1988 murder of P.E.I. teacher Byron Carr were withdrawn due to the unexplained loss of crucial evidence by Charlottetown police.

The missing evidence, which includes the knife and the towel linked to the crime scene, came to light during a bail hearing in July, raising concerns. While the police indicated knowledge of the missing items since 2007 when the case was reopened, they failed to provide the full extent of the missing physical evidence to the Crown earlier, according to Interim Charlottetown police Chief Darren MacDougall.

MacDougall admitted a lack of transparency in disclosing the evidence to the Crown promptly, emphasizing the responsibility of the police for full disclosure. Despite the loss of physical items, the DNA evidence collected from them was preserved, ensuring its integrity. However, the misplaced key exhibits have cast doubt on the case’s credibility, as highlighted by criminologist Michael Arntfield from Western University.

Arntfield expressed disappointment over the disappearance of key evidence, believing it undermines the integrity of the investigation. He emphasized the significance of timely and comprehensive disclosure to the Crown to potentially alter case outcomes. The incident has sparked calls for an independent review of the case’s handling, with MacDougall expressing willingness to cooperate.

The controversy has raised questions about police practices and their impact on case integrity, prompting discussions about potential investigations to address the matter. The need for transparency and collaboration between law enforcement and legal authorities has been underscored to maintain public trust in the justice system.
