“Sexual Assault Case Against ‘Trailer Park Boys’ Actor Dismissed”

A sexual assault case against actor Mike Smith from the TV show “Trailer Park Boys” was dismissed by a Nova Scotia judge after the complainant expressed concerns about the emotional toll of testifying. The trial, scheduled to last three days, was set to start in provincial court in Dartmouth, N.S. However, the Crown did not present any evidence, leading the defense to request dismissal, which Judge Jill Hartlen granted.

Smith, aged 54, faced a charge of sexual assault dating back to an incident on Dec. 30, 2017, in Dartmouth, with his plea of not guilty entered in February. The complainant, who remains anonymous due to a publication ban, shared with CBC News her decision to avoid testifying to protect her mental well-being.

In a released statement, she pointed out the heavy reliance on a victim’s testimony in sexual assault cases and how it can retraumatize survivors. The complainant criticized the process for subjecting victims to public scrutiny while the accused are often shielded from similar distress. Crown prosecutor Bryson McDonald refrained from confirming the complainant’s refusal to testify, citing the inability to disclose confidential communications.

McDonald emphasized that the Crown’s decision to drop the case was based on the diminished prospect of securing a conviction. The complainant expressed frustration with the legal system, citing concerns about character attacks during cross-examinations and defense strategies that blame victims for reporting assaults.

Following the dismissal of the case, Smith’s lawyer, Stan MacDonald, stated that his client is relieved to put the matter behind him and move on. A statement from Trailer Park Boys Incorporated announced Smith’s return to his role as managing director now that the legal proceedings have concluded.
